Terms of Service
1. Introduction
These Terms of Service ("Terms") govern your access to and use of Thumblore ("Thumblore", "we", "us", "our"), operated by Monday Canvas. By creating an account, purchasing credits, subscribing to a plan, or otherwise using the Service, you agree to these Terms.
2. The Service
Thumblore is an AI-powered tool that generates and edits thumbnails and related creative assets. Use of generative features consumes credits as described below.
3. Accounts
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Thumblore. You are responsible for maintaining the security of your account and for all activity that occurs under it.
4. Credits
4.1 What credits are
Credits are a prepaid digital entitlement used to access AI generation features inside Thumblore. Credits have no monetary value, are not a currency, are non-transferable, and cannot be exchanged for cash.
4.2 How credits are consumed
Each generation or edit deducts credits based on the action performed. Current costs are displayed in-app before the action is confirmed. We may adjust per-action credit costs from time to time to reflect underlying model pricing; material changes will be communicated in advance.
4.3 Acquiring credits
You can obtain credits by (a) subscribing to a paid plan that grants a recurring monthly credit allowance, or (b) purchasing a one-time credit top-up.
4.4 Expiry
- Subscription credits reset at the start of each billing cycle and do not roll over unless explicitly stated on the plan.
- One-time top-up credits remain valid for [12] months from the date of purchase.
- Credits are forfeited if your account is terminated for breach of these Terms.
4.5 Failed generations
If a generation fails on our side (server error, model failure, empty output), the credits debited for that action are automatically refunded to your balance. Generations that complete successfully — including outputs you simply do not like — are not eligible for credit refunds.
5. Subscriptions and Payments
All payments are processed by our merchant of record, Dodo Payments ("Dodo"). Dodo Payments handles checkout, billing, tax calculation, invoicing, and payment-method support. By purchasing, you also agree to Dodo Payments's Buyer Terms.
5.1 Recurring billing
Paid plans renew automatically at the end of each billing period (monthly or annual, as selected) using your saved payment method, until cancelled. The renewal price is the price displayed at the time of renewal. We will notify you in advance of any price changes.
5.2 Taxes
Prices shown at checkout may exclude applicable VAT, GST, or sales tax. Dodo Payments, as the merchant of record, calculates and collects taxes where required and remits them to the relevant authorities.
5.3 Failed payments
If a renewal payment fails, we may retry the charge and/or suspend access to paid features until payment succeeds.
5.4 Cancellation
You may cancel your subscription at any time from your account settings or via the link in your Dodo Payments invoice email. Cancellation stops future renewals; you retain access to paid features until the end of the current billing period.
6. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
7. Acceptable Use
You agree not to use Thumblore to generate, upload, or distribute content that:
- infringes intellectual property, publicity, or privacy rights;
- is unlawful, defamatory, harassing, hateful, or violent;
- is sexual content involving minors, or non-consensual sexual content;
- impersonates real people in a misleading or harmful way;
- contains malware or attempts to disrupt the Service;
- circumvents credit accounting, rate limits, or access controls;
- is used to train competing AI models without our written permission.
We may suspend or terminate accounts that violate this section, without refund.
8. Your Content and Outputs
You retain ownership of inputs you upload. Subject to applicable law and the rights of underlying model providers, you own the outputs generated for you and may use them commercially. You are responsible for ensuring you have the rights to any input material you upload (including likenesses, logos, and copyrighted works) and for your use of the outputs.
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. Maintenance, third-party outages (including model providers), and force majeure events may affect availability.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law. AI-generated outputs may be inaccurate, offensive, or unsuitable; you are responsible for reviewing them before publication.
11. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 100. We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, or data.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your account for breach of these Terms, suspected fraud, chargebacks, or as required by law. On termination, your right to use the Service and any remaining credits cease.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after changes take effect constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of Respected Ground , without regard to its conflict-of-laws rules. Disputes shall be resolved exclusively in the respected courts, except where mandatory consumer law grants you the right to bring claims in your country of residence.
